Overview
Welcome to AMUGE. In these terms, "we," "us," and "our" refer to AMUGE.
We operate this online store, including its products, content, and features, to give you a considered shopping experience (the "Services"). The Services run on Shopify's platform.
These Terms of Service, together with all policies referenced in them (the "Terms"), set out your rights and responsibilities when you use the Services.
These Terms include important provisions affecting your legal rights, including disclaimers of warranty and limitations of liability. Please read them.
By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

Section 1 — Access and accounts
By agreeing to these Terms, you confirm that you are of legal age in your place of residence. If a minor in your care uses a device you control, you are responsible for that use.
Using the Services may require you to provide information such as your name, email address, billing details, and shipping address. You are responsible for ensuring that the information you provide is accurate, current, and complete.
You are responsible for safeguarding your account credentials. You may not transfer, sell, or lend your account to anyone else.

Section 2 — Our products
We work to display our products as accurately as possible. Colors and appearance may differ depending on your device and display settings, and we cannot guarantee that what you see on screen matches the physical product exactly.
Product information may change without notice. We reserve the right to discontinue any product, and to limit quantities sold to any region or individual.

Section 3 — Orders
Placing an order is an offer to purchase. AMUGE reserves the right to accept or decline any order at our discretion. An order is not accepted until we confirm it, and acceptance is conditional on payment being received and processed.
All of our products are made to order (print on demand), and production begins as soon as an order is confirmed. Because of this, orders generally cannot be canceled after they are accepted. Please review your order carefully before submitting it.
If we decline, change, or cancel an order, we will contact you using the email address, billing address, or phone number provided with the order.
Returns and exchanges are governed by our Refund Policy.
Products purchased are for your personal or household use. Commercial resale or export is not permitted.

Section 4 — Pricing and billing
Prices, discounts, and promotions are subject to change without notice. The price charged is the price in effect when the order is placed, and it appears in your order confirmation email. Prices shown on product pages include applicable consumption tax.
Shipping is free on all orders to Japan, the United States, and South Korea. Customs duties and import taxes on international shipments are not included in the listed price and are your responsibility. See our Shipping Policy for details.
Prices in our online store may differ from prices offered elsewhere. We may run promotions governed by separate terms; where those terms conflict with these Terms, the promotion terms control.
You agree to provide current, complete, and accurate purchase and payment information for all purchases, and to update that information promptly so we can complete your transaction and contact you as needed.
You represent and warrant that the payment information you provide is true, accurate, and complete; that you are authorized to use the payment method; that the charges will be honored by your card issuer; and that you will pay the listed price and any applicable fees.

Section 5 — Shipping and delivery
All delivery timeframes are estimates, not guarantees. We are not responsible for delays caused by carriers, customs clearance, or other events outside our control. Title and risk of loss pass to you once we hand the goods to the carrier.

Section 6 — Intellectual property
The Services — including all trademarks, brand elements, text, images, graphics, reviews, video, audio, and their design, selection, and arrangement — are owned by AMUGE, its affiliates, or its licensors, and are protected by patent, copyright, and other intellectual property laws in Japan and other countries.
These Terms permit you to use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any material from the Services without our prior written consent. Except as expressly stated, nothing in these Terms grants any license or right under any patent, trademark, copyright, or other intellectual property of AMUGE, Shopify, or any third party. Unauthorized use of the Services may violate copyright, trademark, and other laws. All rights not expressly granted are reserved by AMUGE.
The AMUGE name, logo, product names, service names, designs, and slogans are trademarks of AMUGE or its affiliates or licensors. You may not use them without our prior written permission. Shopify's name, logo, and related marks are trademarks of Shopify. All other names and marks on the Services belong to their respective owners.

Section 7 — Optional tools
The Services may give you access to third-party tools that we neither monitor nor control.
Any such tools are provided "as is" and "as available," without warranties, representations, or endorsements of any kind. We are not liable for any harm arising from your use of third-party tools.
Use of these tools is entirely at your own risk and discretion, and you should review and agree to the relevant third party's terms before using them.
We may add new features and tools in the future. Those will also form part of the Services and be governed by these Terms.

Section 8 — Third-party links
The Services may contain links to websites operated by third parties, including embedded content. We do not investigate or warrant the content or accuracy of those sites. You access them at your own discretion and risk.
We accept no liability for any harm arising from products, services, or content on third-party sites. Please review the relevant policies and terms before using them.
Questions or complaints about a third party's products or services should be directed to that third party.

Section 9 — Relationship with Shopify
The Services run on Shopify's platform, but the sale and purchase of products is conducted directly by AMUGE.
By using the Services, you acknowledge and agree that Shopify bears no responsibility for transactions with our store, including any injury, damage, or loss relating to our products or services.
Shopify and its affiliates are released from all claims, damages, and liabilities arising from your dealings with AMUGE.

Section 10 — Privacy Policy
All personal information we obtain through the Services is handled in accordance with our Privacy Policy. Some personal information may also be subject to Shopify's privacy policy. By using the Services, you confirm that you have reviewed and agree to these policies.
Because the Services run on Shopify's platform, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve them.
Information you submit through the Services may be transferred to, stored on, and processed on servers located outside Japan, where Shopify and its partners operate. For details on how we, Shopify, and our partners handle personal information, please see our Privacy Policy.

Section 11 — Feedback
If you send us ideas, suggestions, reviews, or other material ("Feedback"), whether or not we asked for it, you grant us a free, worldwide, perpetual license to use, reproduce, modify, publish, distribute, and display that Feedback in any medium and for any purpose, including commercial purposes. We may use these rights to operate, improve, promote, or defend the Services.
You represent that (1) you hold all rights necessary to submit the Feedback, (2) you have disclosed any compensation or incentive received in connection with it, and (3) the Feedback complies with these Terms.
We have no obligation to (1) keep Feedback confidential, (2) pay compensation for it, or (3) respond to it.
We may, but are not obliged to, monitor, edit, or remove content we consider unlawful, offensive, defamatory, obscene, or in violation of third-party intellectual property rights or these Terms.
You agree that your Feedback will not infringe any third-party right, including copyright, trademark, privacy, or publicity rights, and will not contain viruses, malware, or anything else that could impair the Services. You may not use a false email address, impersonate another person, or otherwise mislead us about the origin of your Feedback. You are solely responsible for the accuracy of your Feedback, and we accept no responsibility for material posted by you or any third party.

Section 12 — Errors, inaccuracies, and omissions
Occasionally information on the Services — product descriptions, pricing, promotions, shipping costs, delivery times, availability — may contain typographical errors, inaccuracies, or omissions.
We reserve the right to correct any such error at any time, and to change or update information or cancel an order without prior notice, even after the order has been submitted, if we determine the information was inaccurate.
Except where required by law, we are under no obligation to update, amend, or clarify information on the Services.

Section 13 — Prohibited uses
The Services may be used for lawful purposes only. You may not use or access the Services, directly or indirectly, for any of the following:

(1) Any unlawful purpose, or any malicious purpose contrary to public order and morals
(2) Violating any applicable law, regulation, or ordinance in Japan or elsewhere
(3) Infringing the intellectual property rights of AMUGE or any third party
(4) Harassing, abusing, insulting, defaming, threatening, or harming our staff or other users
(5) Submitting false or misleading information
(6) Sending, uploading, downloading, or reusing material that does not comply with these Terms
(7) Sending or soliciting spam, chain letters, or other advertising or promotional material
(8) Impersonating, or attempting to impersonate, another person, entity, or AMUGE
(9) Interfering with other users' use of the Services, or any conduct we determine may harm AMUGE, Shopify, or other users

Technical and operational interference
(a) Uploading or transmitting viruses, malware, or other malicious code that affects the operation of the Services
(b) Reproducing, copying, extracting, selling, reselling, or commercially exploiting any part of the Services — content, images, product data — without our permission
(c) Collecting or tracking the personal information of others without authorization
(d) Phishing, fraud, or improper impersonation, including pretexting
(e) Using robots, spiders, scrapers, or AI tools, including agentic AI, to collect, extract, or access data through automated means
(f) Circumventing or disabling security features or access restrictions of the Services

If we determine that you have violated any of these prohibitions, we reserve the right to suspend, disable, or terminate your account or access immediately and without prior notice.

Section 14 — Automated agents
14.1 This section (the "Agent Terms") applies where you use or deploy automated programs, AI agents, or autonomous software ("Agents") to access or operate the Services. An Agent is software or a service capable of taking autonomous or semi-autonomous action on instruction, without direct human supervision.
14.2 Agents may not access or operate the Services unless they identify themselves at all times and strictly comply with Section 14.4. If we request that a particular Agent cease access, it must stop immediately.
14.3 We reserve the right to use technical measures to limit or block Agent access to the Services.
14.4 If you use an Agent, you must meet all of the following:
(1) Identify the Agent by including "Agent/[name]" in the user-agent string of every HTTP/HTTPS request.
(2) Not conceal Agent access by mimicking human interaction patterns or circumventing security measures such as CAPTCHA.
(3) Respond honestly to any prompt or challenge intended to determine whether the visitor is human or automated.
(4) Not circumvent or disable technical measures we use to restrict or control Agent access.

Section 15 — Suspension and termination
We may terminate these Terms and your access to the Services, or any part of them, at any time and at our discretion, without notice. You remain responsible for all amounts owed as of the termination date.
The following sections survive termination: intellectual property, feedback, disclaimer of warranties, limitation of liability, indemnification, severability, waiver, entire agreement, assignment, governing law, the Privacy Policy, and any other provision that by its nature should survive.

Section 16 — Disclaimer of warranties
Information provided through the Services is for general informational purposes. We make no warranty, express or implied, as to its accuracy, completeness, or usefulness. Any decision or action taken on the basis of that information is your own responsibility.
Except where AMUGE has expressly stated otherwise, the Services and all products are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, durability, and non-infringement.
We do not warrant that the Services will be uninterrupted, timely, secure, or error-free.
Some jurisdictions limit the exclusion of implied warranties; where that applies, parts of this section may not apply to you, and our liability will be limited to the maximum extent permitted by law.

Section 17 — Limitation of liability
To the maximum extent permitted by law, neither AMUGE nor our partners, directors, officers, employees, affiliates, agents, contractors, service providers, or licensors, nor Shopify and its affiliates, shall be liable for any damages arising from your use of the Services or of any product purchased through them.
This includes direct, indirect, incidental, special, and consequential damages, including lost profits, lost revenue, lost data, and the cost of substitute goods.
Where we are nonetheless found liable under applicable law, our total liability, regardless of cause, shall not exceed the total amount you paid us through the Services in the preceding three months.
Some jurisdictions do not allow the limitation of liability for incidental or consequential damages; where that applies, our liability will be limited to the maximum extent permitted by law.

Section 18 — Indemnification
You agree to indemnify, defend, and hold harmless AMUGE, Shopify, and our respective affiliates, partners, officers, employees, agents, and contractors from any third-party claim, loss, damage, liability, or expense, including reasonable legal fees, arising out of or relating to:
(1) your breach of these Terms or any policy referenced in them
(2) your failure to comply with applicable law, or your infringement of a third party's rights
(3) your access to or use of the Services
We will notify you of any claim subject to indemnification. A delay in notice does not release your obligations under this section unless it materially prejudices you.
We may, at your expense, control the defense and settlement of any such claim, and you agree to cooperate fully, including by providing relevant materials.

Section 19 — Severability
If any provision of these Terms, or part of one, is held unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall remain effective to the fullest extent permitted by law.
The unenforceable portion shall be treated as severed from these Terms, and that determination shall not affect the validity or enforceability of any remaining provision.

Section 20 — Waiver; entire agreement
Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision going forward.
These Terms, together with all policies and operating rules we post in connection with the Services, constitute the entire agreement and understanding between you and us, and govern your use of the Services. They supersede any prior or contemporaneous agreements, communications, and proposals, whether oral or written, including any earlier version of these Terms.
Any ambiguity in these Terms shall not be construed against us as the drafting party.

Section 21 — Assignment
You may not assign, transfer, pledge, or otherwise dispose of your contractual position, rights, or obligations under these Terms without our prior written consent. Any purported assignment in breach of this is void.
If we transfer the business operating the Services — through a business transfer, corporate split, merger, or similar — we may transfer our contractual position, rights, and obligations under these Terms, together with your registration and other customer information, to the transferee. You are deemed to have consented in advance to such a transfer under this provision.

Section 22 — Governing law and jurisdiction
These Terms, and any contractual relationship arising between you and us in connection with the Services, are governed by the laws of Japan.
Any dispute arising between you and us in connection with the Services shall be subject to the exclusive jurisdiction of the court having jurisdiction over our principal place of business, as the court of first instance.

Section 23 — Headings
Section headings are for convenience only and do not limit or otherwise affect the scope of these Terms.

Section 24 — Changes to these Terms
The most current version of these Terms is always available on this page.
We reserve the right to update, change, or replace any part of these Terms at our discretion by posting updates to this website. Please check this page periodically for changes.
If we make a material change, we will give you advance notice by reasonable means, such as a notice on the site or an email. The revised Terms take effect on the date stated in that notice or posting.
Continuing to use or access the Services after changes are posted means you accept the revised Terms.
